1. Agreement to Terms

By accessing or using the VitalCheck platform ("Service"), operated by Mazano Health (Pvt) Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

These Terms apply to all users of the Service, including employers, insurers, clinical administrators, employees, and individual members.

2. Description of Service

VitalCheck is a contactless biometric wellness screening platform that captures vital health metrics using camera-based technology. The Service includes:

  • Employee and member wellness screening
  • Administrative dashboards for employers, insurers, and clinical teams
  • Actuarial and underwriting intelligence
  • Reporting and data export tools
  • Patient portal for individual health tracking

3. Not Medical Advice

VitalCheck is a wellness screening platform, not a medical device or clinical laboratory. The Service does not provide medical diagnoses, treatment recommendations, or clinical decision support.

Screening results are for informational and wellness purposes only. They do not constitute a medical diagnosis and should not be used as a substitute for professional medical advice, examination, or treatment.

If you have concerns about your health, consult a qualified healthcare provider. In case of a medical emergency, contact your local emergency services immediately.

4. User Accounts and Access

Access to the Service requires authentication. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk.

5. Employer and Insurer Obligations

Organizations using VitalCheck for employee or member screening agree to:

  • Obtain appropriate consent from employees/members before screening
  • Not use individual screening results for employment decisions, disciplinary action, or coverage denial unless explicitly permitted by applicable law
  • Comply with all applicable data protection laws in their jurisdiction
  • Use aggregate data only for its stated purpose (workforce health improvement, actuarial analysis, etc.)
  • Not attempt to re-identify anonymized or aggregated data

6. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, store, and protect personal and health data.

Key commitments:

  • Biometric data is encrypted at rest (AES-256-GCM) and in transit (TLS 1.3)
  • Dates of birth are SHA-256 hashed and never stored in plain text
  • Aggregate reports enforce k-anonymity to prevent individual re-identification
  • We comply with the Zimbabwe Data Protection Act 2021, GDPR, and applicable local regulations
  • Employees and members have the right to access, correct, and delete their data

7. Intellectual Property

The Service, including its design, code, algorithms, dashboards, reports, and documentation, is the intellectual property of Mazano Health (Pvt) Ltd. You may not:

  • Copy, modify, or distribute any part of the Service
  • Reverse-engineer, decompile, or disassemble the Service
  • Use the Service to build a competing product
  • Remove or alter any proprietary notices

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice)
  • Emergency security patches
  • Force majeure events
  • Third-party service outages

We are not liable for any losses arising from Service unavailability.

9. Limitation of Liability

To the maximum extent permitted by law, Mazano Health shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Medical decisions made based on screening results
  • Inaccuracies in biometric readings (screening is not a diagnostic tool)

Our total liability for any claim arising from the Service shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Mazano Health, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your failure to obtain proper consent from employees or members

11. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered account holders at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Zimbabwe. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.

For users in the Cayman Islands, the Cayman Islands Data Protection Act (2017) shall apply to data protection matters in addition to these Terms.
